The article briefly describes the history of GNU and Free/Libre Open Source Software initiatives and outlines differences between ideas for software development that these notions have advocated. It also discusses the GNU GPLv3 provisions with relation to copyrights, trade secrets, patent law, trade mark law, and legal enforcement of this licence. All this is followed by the author’s thoughts on the most important axiological implications of the GNU GPL/FLOSS licences on the IT/digital industry, digital economy, and the idea of the Information Society.

In some recent Singapore trade mark cases, the courts exhibited a more circumspect attitude towards the concept of trade marks that go beyond their traditional function as badges of origin. This article examines how these cases provide the counter-balancing force to rein in the ever expanding concept of trade marks; an expansion required under the 2003 US-Singapore Free Trade Agreement.
