The copyright term “work”is crucial because the rules of copyright law can only be applied if a product is a copyright work. As the ECJ started in the decision Infopaq to interpret this term, the consequences might cause a significant step towards further harmonisation of this important term within the European Union and, thus, put the CDPA 1988 and its jurisprudence on the test. This might cause adaptations concerning, e.g. the categories of copyright works, the tangible form and the originality required for copyright work.
