Election Dispute Resolution in Election Law

Mechanism by which every electoral action or procedure can be legally challenged and disagreements resolved. Appeals related to electoral issues should be submitted to the competent judicial administrative, civil or electoral authorities. The aim is to ensure real protection for and effective enforcement of the political rights to elect or to be elected. To do so, the system must satisfy all stakeholders that the voter's choice will prevail. The legal framework around an election should therefore clearly state that every voter, candidate and political party has the right to lodge a complaint with the EMB or court, and require that authority to render a prompt decision. It must also provide the right to appeal to an administrative or civil legal body of last resort.
