Agreements With Nauru and Tuvalu in 2011

United States views on international law (based on the document “Digest of U.S. Practice in International Law”): On September 8 and 9, 2011, the United States concluded virtually identical agreements with the Republic of Nauru and Tuvalu, respectively, concerning cooperation to suppress illicit transnational maritime activity. Article 2 of the agreements set forth the purpose of the agreements in a manner identical to that of the Senegal agreement referenced above. The agreements with Nauru and Tuvalu also include shiprider provisions similar to the provisions in the agreement with Senegal. In addition, the agreements with Nauru and Tuvalu authorize U.S. law enforcement officials operating even without any embarked officials from the other Party to board and search suspect vessels and persons on board if the vessels claim registry or nationality in the other Party and are located seaward of any nation’s territorial sea.
