The Curious Case of Greening in Carbon Markets

Over the last several years, so-called “carbon markets”have emerged around the world. These markets trade greenhouse gas credits. This article takes a close look at an unexpected and unprecedented development-premium “green”currencies have emerged alongside and even displaced standard compliance currencies. Past experiences with other environmental compliance markets, such as the sulfur dioxide and wetlands mitigation markets, suggest the exact opposite should be occurring. Indeed, buyers in such markets should only be interested in buying compliance, not in the underlying environmental integrity of the compliance unit. In carbon markets, however, higher quality green credits have emerged in recent years as important currencies for a number of buyers, representing a dynamic that we refer to as “Gresham’s law in reverse”-more stringent currencies emerging alongside and even displacing inferior currencies. This piece provides the first recognition and analysis of green differentiation in environmental markets. We explore a range of explanations for this curious development. We then identify potential lessons for the design and evolution of future carbon markets and, more generally, environmental compliance markets.

“Establishment”: A Core Concept in Chinese Inbound Income Taxation

Analogous with the concept of a U.S. “trade or business”in U.S. federal income tax law, the concept of “establishment”under Chinese tax law determines the boundary between net-income and gross-income taxation of inbound investments. As central as the concept is, it has received surprisingly little interpretation.

Sustainable Agriculture within WTO Law and Arab Countries

The article examines the implications of the WTO Agreement on Agriculture on agriculture in Arab countries. The article addresses the extent to which realisation of the Agreements objective-the creation of a fair and market-oriented agricultural trading system-is likely to promote sustainable ag?culture, especially food security, in Arab countries. The article concludes that the agriculture trade rules are found wanting. Thus levelling the playing field between industrialised and Arab countries is necessary. Promotion of food security requires additional trade reforms to provide Arab countries with a wide array of tools to ensure access to food.

New Shipper Review in India: Need fora Procedural Code

While India is seen ass lucrative market for trade, world over, the Indian Government is very active in protecting its domestic industry from any injury that results from any unfair trade practice. Imposition of anti-dumping duties is one such method of protecting the domestic industry. The Agreement on Implementation of the Article VI of GATT provides for a ne? shipper review which gives a ne? producer/exporter an opportunity to avoid the maximum duty imposed and to get a duty determination for itself. Neither the Agreement of Implementation of Article VI of GATT nor the Indian law incorporating such principles specifies the procedure to be followed by the Indian authority in conducting a new shipper review. The present article studies the various issues that have arisen for consideration in a new shipper review and the procedure followed by the Indian authority in conducting such review.
