The subject of “law” has remained in the background of both popular and academic discussions about globalisation and its impact. Generally, it is understood that globalisation was brought about by a “new economy”one that has resulted from a combination of dramatic technological change, and the liberalization of trade and capital. The contention in the business literature is that these developments have altered business practices, encouraged new approaches to industrial production and instigated new structures for corporate organization. In the economic sense, the concept of a “new economy” refers to a new “paradigm based on technology, innovation and intellectual property.” Economists working in the field are generally interested in understanding the connection between technological innovation and economic growth.

This article, which is a written version of more informal remarks delivered at the Food and Drug Law Institute’s 47th Annual Conference, provides some personal views about the ongoing dialogue between the Food and Drug Administration and the Federal Trade Commission, with particular emphasis on the issues raised by direct-to-consumer advertising of prescription drugs. This dialogue is inevitable because each agency has authority in the area of consumer communications, but they have very different ultimate responsibilities.
