Most recent case law of the Court of First Instance and European Court of Justice raise concerns regarding the assessment of risk of confusion. As trademark protection is intended to protect the interests of trademark owners, this case law seems to approach the problem of risk of confusion from the consumer’s perspective. This contribution outlines why this approach requires rectification.

Part 2 of this article discusses parallel imported pharmaceuticals within the EEA and its unique set of problems regarding relabelling and rebating, and debranding and co-branding. It reviews the law in this area and concludes it is still quite unclear despite numerous ECJ referrals following the conditions set out in the Bristol-Myers Squibb case. The article also discusses potential practical ways for pharmaceutical brand owners to deal with parallel imports.
