Introduction to Right of Access
Right of Access, legal incident of the ownership of property abutting on the sea or other navigable waters, or on a highway or other public lands. It is of the nature of a servitude or easement. Access to air as against a neighboring proprietor can be acquired only as an easement. The right of access to a highway over the land of another is also of the nature of an easement that will in certain cases, as when such access is necessary for entrance and exit, be presumed to exist.” (1)
