Introduction to Permanent Court of Arbitration

Permanent Court of Arbitration, panel of arbitrators established by the Convention for the Pacific Settlement of International Disputes, signed by 24 nations at the first international peace conference at The Hague, the Netherlands, in 1899. The panel was set up to facilitate the arbitration of international disputes. Under the convention, each of the contracting nations was permitted to select as many as four arbitrators, who were listed as members of the court and served for six years. The names of the members were kept on record, and disputing nations had access to the list to choose a tribunal of arbitrators to settle their differences. The court has never met as a body and is permanent only in that a panel exists from which arbitrators can be chosen.

Before World War I the court participated in the settlement of 15 cases, among which were the North Atlantic Coast Fisheries Arbitration between the United States and the United Kingdom; the Preferential Claims Arbitration among the United Kingdom, Italy, Germany, and Venezuela; and the Casablanca Deserters Arbitration between Germany and France. After World War I most nations came to believe that arbitration was not a satisfactory means of settling disputes, and the court was utilized less often. The example and reputation of the court were, however, influential in the decision to create the Permanent Court of International Justice in 1921.” (1)

The Permanent Court of Arbitration “is an international organization offering a broad range of services for resolving disputes between States, as well as disputes between States and private parties and those involving inter-governmental organizations.” Information about the PCA and its publications, plus PCA Conventions (i.e., treaties), Rules of Procedure, and Model Clauses are all posted on the PCA Web site (www.pca-cpa.org).
The PCA helps publish some of the leading materials on international commercial arbitration These include materials by the International Council for Commercial Arbitration (ICCA), such as the Yearbook Commercial Arbitration, the International Handbook on Commercial Arbitration and the ICCA Congress Series, as well as the Arbitration CD-ROM, Resources on International Commercial Arbitration, produced in conjunction with Kluwer Law International.

The Permanent Court of Arbitration the Nucleus of the Future Organization of the Family of Nations

Lassa Oppenheim, in the book entitled The Future of International Law, about The Permanent Court of Arbitration the Nucleus of the Future Organization of the Family of Nations, wrote in 1921: 24. I said, we have the beginning of the development before our eyes. It consists in the erection of the Permanent Court of Arbitration at The Hague, and in the permanent Bureau attached thereto. Here we have an institution belonging not to the individual contracting states but to the international society of states in contrast to the individual members, and it is open to the use of all the individual members. If the Declaration of London be ratified, and if (which scarcely admits of doubt) it be adopted by all the states which were not represented at the Conference of London, then the International Prize Court, which was decided on at the second Hague Conference, will become a fact. This Court will also become an organ of the international community. Mention must also be made of the so-called international bureaux of the so-called international unions, which have come into existence in the period beginning with 1874; for some at least of them will develop into organs of international society, although they so far are only organs of the respective special international unions.
