US Agreement With Palau in 2013

United States views on international law [1] in relation to Agreement With Palau: On August 15, 2013, the United States and the Republic of Palau signed a bilateral maritime law enforcement agreement. The agreement, which entered into force upon signature, supersedes the Cooperative Shiprider Agreement between the Government of the United States of America and the Government of the Republic of Palau by exchange of notes at Koror and Melekeok on March 5 and March 20, 2008. The new agreement will facilitate law enforcement cooperation between Palau and the United States on fisheries and counter-narcotics. As provided in Article 2 of the agreement, its purpose is to “strengthen ongoing cooperative maritime surveillance and interdiction activities between the Parties, for the purposes of identifying, combating, preventing, and interdicting illicit transnational maritime activity.” The agreement contains shiprider provisions, allowing officers of Palau’s Division of Marine Law Enforcement to embark on U.S. law enforcement vessels or aircraft to conduct joint operations. These vessels or aircraft carrying “embarked law enforcement officials” may be authorized on a case-by-case basis to enter the territorial sea of Palau to assist in stopping, boarding, and searching vessels suspected of violating Palau’s laws and in arresting suspects and seizing contraband and vessels. The agreement also permits U.S. law enforcement vessels and aircraft, with embarked officers, to assist in fisheries surveillance and law enforcement activities in Palau’s exclusive economic zone. For operations without an embarked Palauan law enforcement official, the agreement further authorizes the United States to board and search suspect vessels claiming registry or nationality in Palau and located seaward of any State’s territorial sea.
