Introduction to Malicious Prosecution
In the tort of malicious prosecution the tortfeasor knowingly brings a groundless criminal proceeding against another. For example, a person who knowingly makes a false accusation of theft against another commits the tort of malicious prosecution. A person who makes anonymous, threatening phone calls to someone and frightens him or her commits the tort of intentional infliction of emotional distress.” (1)
