Juristic Acts

Juristic Acts

Classification

There is literary warrant for juristic acts. Among the places to look for works about this subject matters are the works with the following Library of Congress Classification (LCC) K numbers:
KK1047 (Law of Germany – Civil law. Bürgerliches Recht – Concepts and principles. Allgemeiner Teil – Legal transactions. Rechtsgeschäfte – General)
KK1048 (Law of Germany – Civil law. Bürgerliches Recht – Concepts and principles. Allgemeiner Teil – Legal transactions. Rechtsgeschäfte – Juristic acts. Rechtmässige Handlungen)
KKH504 (Italy – General – Civil law – General principles – Acts and events – General)
KJV487 (Law of France РCivil law. Droit civil РJuristic facts and acts. Causalit̩ juridique РJuristic acts. Actes juridiques РGeneral).

The Library of Congress Classification also has a very general number for juristic acts: K270 (Law in general. Comparative and uniform law. Jurisprudence – Jurisprudence. Theory and philosophy of law – Acts and events – Juristic acts).

That number K270 would suggest placement, in the Dewey classification system, in 340.1, and indeed works on juristic acts have been classed in 340.1 in the Dewey decimal classification. Nevertheless, there is clearly a narrower meaning of juristic acts.

“Juristic acts” and “Contracts”

In the Library of Congress Subject Headings “Juristic acts” and “Contracts” are related terms. In the Library of Congress Classification, juristic acts and contracts are not as close together as the Dewey system (or, at least, in the proposals), but there is clear link to contracts by a see reference, at least under German law (see: from KK1090.22 Law of Germany – Civil law. Bürgerliches Recht – Concepts and principles. Allgemeiner Teil – Legal transactions. Rechtsgeschäfte – Contracts to KK1640 – KK1686 – Law of Germany – Civil law. Bürgerliches Recht – Obligations. Schuldrecht – Contracts. Vertragsrecht).

There is a problem with “Juristic acts” and “Contracts” being related terms i the Dewey classification system: if “juristic acts are a more general and comprehensive category” than contracts, and contracts approximate the whole of 346.02 (“Subdivisions are added . . . for contracts alone” ), then juristic acts cannot logically be placed in a subdivision of 346.02 at 346.021.

Therefore, the team of the Dewey classification system proposed to make only juristic acts approximate the whole of 346.02 and to move the comprehensive number for contracts to 346.022, then develop 346.021 for general considerations of juristic acts.
