The World Health Organization (WHO) is the United Nations agency responsible for making international law in the area of public health. One of the only areas in which the WHO has enacted international law is the field of infectious diseases. This law, known as the International Health Regulations (IHR), is severely out of date and does not include most of the diseases currently of world concern. The WHO is in the process of updating the IHR, and the revisions will help the IHR be more effective at their purpose of preventing the spread of disease with minimal interference in world trade. But issues of surveillance (especially at the domestic level), compliance, and enforcement must be addressed in order for the new IHR to truly be effective. Overall, the WHO needs to be more willing to use their legal authority; the IHR alone will not stem the international spread of disease, and the WHO should enact legislation to expand and buttress the surveillance requirements of the IHR.

This article looks at recent cases resolving disputes over the electronic media rights of freelance journalists and publishers in the United States and Europe. This article considers the implications of conflicting case law for international electronic trade in copyrighted works and suggests international solutions that attempt to balance fairly the competing interest of freelancers, publishers, and the new electronic media industries.
