O’Reilly examines the Eritrean government’s role in trafficking its citizens into slavery via its National Service Program, and she proposes several policies the international community could pursue to help bring an end to these abuses. Specifically, she discusses the following: (1) the possibility of the Security Council referring the Eritrean situation to the International Criminal Court (I.C.C.) in The Hague, (2) the ability of the American courts to combat the abuses, and (3) the political intractability of the problem, stressing the fundamental requirement that the international community obtain more information and more access to Eritrea.

Nicole Rementer analyzes the legislative oversight of the U.S. and U.K. intelligence agencies in light of the recent allegations of the respective governments’ use of an complicity in torture to gan post-9/11 intelligence. Rementer concludes that legislative oversight policies and procedures have fails to ensure compliance with the U.S. and U.K.’s international obligations against torture, and the article outlines recommendations for an active legislative role in striking a balance between transparency and national security.

The causes of the recent global financial crisis (GFC) have been a topic of intense debate, with commentators and others pointing to the enormous growth in, and relative lack of regulation of, derivative financial products, including over-the-counter equity swap agreements, as a contributing factor. In New Zealand the Court of Appeal held in Ithaca (Custodians) Ltd v Perry Corp [2004] 1 NZLR 731 that such swap agreements referencing substantial holdings in underlying securities of a particular company did not require disclosure under the substantial security holder disclosure provisions. This article analyses that decision in the context of the GFC and international regulatory trends, arguing that New Zealand’s provisions require reform.

Women in South Africa are generally poorer than men and more vulnerable. They perform the bulk of the caring functions in society, usually without remuneration. Their greater need is reflected in their disproportionate use of the social assistance system. This system is evaluated in terms of the right to social security contained in South Africa’s Bill of Rights. The right is explored, interpreted and developed from a feminist legal perspective. The categories of reformism, feminist critique and utopianism are used to ‘engender’ the right. International law, as well as the emerging jurisprudence on the right to social security, is considered in the reconceptualisation of the right. This article briefly discusses some of the gender dimensions of each of South Africa’s three, largest social assistance grants-the Old Age Pension, Child Support Grant and Disability Grant. It points to some of the areas of research and future examination that would assist those attempting to expand the meaning and reach of the right to social security so that it is able to help everyone in South Africa, and in particular, poor women to ‘improve their quality of life’ and ‘free their potential’.
