Innocent Passage

Summary of Innocent Passage

The right of a ship of one state to transit the territorial sea of another state, so long as the voyage does not disturb the peace or well-being of the coastal state. This right is subject to limitations, such as the right of the coastal state to prescribe reasonable rules governing navigation and pollution. A vessel in contravention of such regulations may be subject to seizure, excepting warships or public vessels, which enjoy sovereign immunity. Additional restrictions may apply to warships; for example, submarines must transit on the surface. Violations by public vessels are normally treated through diplomatic channels.
