In a series of recent judgments the European judicature has confirmed the State centric nature of the enforcement regime. The rulings nonetheless establish the Community law principles and rights that national supervisory and judicial proceedings must protect. A key feature of the rulings is the connection between the regulatory objective of enhancing competition and the right to effective judicial protection.

This article discusses the interplay between patent and competition in the Chinese context. First, it highlights the problems facing China in relation to the patent. It then looks at the relationship between patent law and antitrust law in the general sense. Finally, it examines the Chinese Anti-Monopoly Law (AML), compares the practices in the European Union and United States, and addresses the issue of refusal to license under the AML.
