The article discusses the relationship between the national courts of 12 new Member States of the European Union (EU), particularly Estonia, and the EU law. The national courts of these countries have to resolve cases based on the supremacy of the EU law over their national law and their national Constitutions . As stated, the Supreme Court of Estonia’s first reference to the European Court of Justice on May 14, 2007 may finally open a constructive dialogue between the two courts.

The article presents a panel discussion on arbitrating competition law issues with William Rowley, Sir David Edward, Phillip Landolt and Christoph Liebscher. Rowley raises three questions concerning the two types of competition law arbitration. Edward affirms that competition law and Article 81 of the European Competition law are matters of public policy. Landolt expresses concern over the European Union’s silence on international arbitration. Liebscher notes the rule that competition law issues may only be addressed within the domain of public policy
