Introduction to Costs
Costs, in law, a sum of money that the successful party in a lawsuit or other legal proceeding is allowed to recover from an adversary in order, theoretically, to be reimbursed for the expense of conducting the litigation. In practice, such expense is often nominal; attorneys’ fees are not properly regarded as costs. In actions in which such fees are permitted by the court, the party seeking them will demand costs plus attorneys’ fees. Costs ordinarily are set in civil actions.” (1)
