Summary of Berth No Berth

A stipulation that may be included in a vessel charter party (read this and related legal terms for further details) providing that if the point of loading or discharge is a berth, and if the berth is not immediately available upon the arrival of the vessel in port, the vessel owner may give NOTICE OF READINESS (read this legal term for further details), after which LAYTIME (read this and related legal terms for further details) will begin to run. In some charter parties, this stipulation is expressed by the statement “Whether in berth or not.”
