Bankruptcy-Remote (SPE) in Financial Law
Concept of Bankruptcy-Remote (SPE) in this field: An SPE satisfying certain legal criteria, whose assets have been isolated from and are outside of the reach of the creditors of the institution from whom it purchased the assets. Bankruptcy remoteness is a critical feature of SPEs that protects the investors that purchase the securities issued by the SPE.

From the book The Clergyman’s Hand-book of Law, about Bankruptcy, Creditors (1): There is no provision of law for a church corporation to make an assignment in bankruptcy. However, the church corporation may be sued and a receiver appointed to take possession of the property and sequester the assets.536 But where assignments in bankruptcy and a sale and conveyance of church property are lawful, the church property may be assigned for the benefit of the creditors.537
