Following a motion for summary judgment, YouTube and their co-defendants succeeded in showing that they are entitled to rely upon the “safe harbour”protection in USC § 512(c) of the Digital Millennium Copyright Act. As well as considering the legislative history of USC § 512(c) and the relevant recent case law, the judgment examines the impact of specific user infringement policies on the right to rely upon the safe harbour protection.

The reproduction of newspaper headlines and summaries of newspaper articles by the publisher of a subscriber news service has been held not to infringe copyright. The headlines were not literary works in which copyright subsisted and the service did not reproduce a substantial part of the articles. The use of the headlines was also found to be a fair dealing for the purpose of reporting news.
